Entity: Rising Talent Academy (the "Academy")

1. ACCEPTANCE OF TERMS

By accessing the website, digital applications, or syndicated feeds of Rising Talent Academy, the user ("User") agrees to be bound by these Terms of Use, all applicable laws, and regulations. If the User does not agree with any of these terms, they are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

2. USE LICENSE AND EDITORIAL RESTRICTIONS

Permission is granted to temporarily download one copy of the materials on the Academy's website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not:

  • Modify or copy the materials.

  • Use the materials for any commercial purpose, or for any public display (commercial or non-commercial).

  • Attempt to decompile or reverse engineer any software contained on the Academy’s website.

  • Remove any copyright, watermark, or other proprietary notations (specifically those belonging to the FIA, FOM, or the Academy).

  • Transfer the materials to another person or "mirror" the materials on any other server.

3. PROHIBITED CONDUCT (EVENT INTEGRITY)

In accordance with our commitments to international sporting federations, Users are strictly prohibited from using the Academy's platform to:

  1. Distribute Unauthorized Footage: Upload or link to unauthorized "bootleg" streams or recordings of FIA-sanctioned events.

  2. Data Scraping: Use automated systems (bots, spiders, or scrapers) to harvest live timing data, telemetry, or accreditation information.

  3. Impersonation: Falsely claim to be a representative of the Academy to gain access to restricted areas or media zones at events.

4. USER-GENERATED CONTENT

If the User posts comments, forum entries, or media to the Academy's platform, the User grants the Academy a non-exclusive, royalty-free, perpetual, and worldwide license to use, reproduce, and distribute that content.

  • The Academy reserves the right to remove any content that is deemed defamatory, racist, or in violation of the FIA Statutes regarding the "spirit of the sport."

5. DISCLAIMER AND LIMITATION OF LIABILITY

The materials on the Academy’s website are provided on an 'as is' basis.

  • Accuracy: While the Academy strives for journalistic excellence, we make no warranties regarding the absolute accuracy or reliability of the use of the materials on our website.

  • Liability: In no event shall the Academy or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the Academy’s website.

6. EXTERNAL LINKS AND THIRD-PARTY AFFILIATIONS

The Academy has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the Academy.

Important Note: Mention of the FIA, Formula 1, or specific racing teams does not imply an official partnership or sponsorship unless explicitly stated. All trademarks remain the property of their respective owners.

7. INDEMNIFICATION

The User agrees to indemnify and hold harmless Rising Talent Academy, its officers, directors, and employees, from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt (including but not limited to attorney's fees) arising from the User's violation of these Terms or the infringement of any third-party intellectual property rights.

8. GOVERNING LAW AND DISPUTE RESOLUTION

Any claim relating to the Academy’s website shall be governed by the laws of the Academy’s home jurisdiction without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts of that jurisdiction.

9. TERMINATION OF ACCESS

The Academy reserves the right, in its sole discretion, to terminate a User’s access to the platform without notice for any breach of these Terms, particularly breaches involving the unauthorized distribution of proprietary sporting data or media.

Compliance Attestation: This document serves to protect the integrity of the media output generated by Rising Talent Academy and ensures that our audience interacts with our content in a manner that respects the commercial and legal frameworks of the FIA.
